Comprehensive and Supports Waiver (DD Waiver) case managers and providers must be approved by the State of Wyoming to deliver waiver services. The application process requires providers to submit documentation of eligibility and in some cases may require a site visit. No person or entity that provides services to a recipient shall receive Medicaid funds unless the person or entity is a party to a fully executed provider agreement, is enrolled, and has fulfilled all waiver program expectations.

Electronic Visit Verification (EVV)
Electronic Visit Verification (EVV) is a federal requirement of the 21st Century Cures Act, which outlines the system requirements for compliance and uses technology to electronically capture information about when and where home and community-based services (HCBS) of the Medicaid waivers begin and end. The Wyoming Department of Health has partnered with CareBridge EVV as a solution, free of charge for DD Waiver providers.

Background Screening Information
New Processes
Effective April 1, 2024 – Traditional Providers
Background screening processes have changed for traditional DD Waiver providers. Screenings submitted to the Wyoming Department of Health for processing will be returned to the provider, along with any payment(s) received. The new screenings (see below) replace the previously required fingerprinted criminal background screenings.
Effective August 1, 2024 – Participant-Directed Employees
The background screening process for NEW Participant-Directed Employees has changed. Participant-Directed Employers are asked to follow the instructions provided by ACES$ in their FMS enrollment packet to ensure that screening costs can be paid by the Division.
ACES$ will accept new employee enrollment packets that include completed screening results from either process (screenings done by ACES$ or by the Wyoming Department of Health) through the end of the year (December 31, 2024). However, beginning October 1, 2024, any Participant-Directed screening requests received by the Wyoming Department of Health will be returned to the Participant-Directed Employer with instructions to contact ACES$ and use the updated process.

As outlined in Wyoming Medicaid Rule Chapter 45, Section 14, a complete background screening is required, for the following individuals:

- All persons providing waiver services including: managers, supervisors, and direct care staff
- Other individuals who, on behalf of the provider, have unsupervised access to participants
- All adults (18+) residing in a location where services are provided (excluding participants)
A complete background screening includes:

- Criminal Background Screening based on Name and Social Security Number
- Providers may use any screening agency which uses a name and social security based database to confirm that individuals subject to background screenings have not been convicted of, or plead “no contest” to, any barrier crimes listed in Wyoming Statute Title 6, Chapters 2 and 4.
- The HCBS Section does not support or recommend a specific agency to conduct background screenings. Some popular background screening agencies include: Direct Screening, Good Hire and Sentry Link.
- Search of the United States Department of Health and Human Services, Office of Inspector General (OIG), List of Excluded Individuals/Entities
- Any provider that hires an individual or entity listed on the OIG Exclusions Database may be subject to civil monetary penalties. To avoid these penalties, providers are required to routinely check the database – at least annually – to ensure that new hires and current employees are not listed.
- Wyoming Department of Family Services (DFS) Central Registry Check
- DFS Central Registry – complete and submit the electronic form to start this portion of the background screening process.
- Criminal Background Screening based on Name and Social Security Number
Subsequent Background Screenings
Circumstances can change over time; therefore, all providers and associated staff are required to complete a full subsequent background screening every five years. The five years is calculated based on the date the last background screening results were issued.
“Does Not Meet” Determinations
Pursuant to Wyoming Medicaid Rules, an individual does not meet the background screening requirements:
- If listed on the Department of Health and Human Services Exclusions Database;
- If listed on the DFS Central Registry;
- If a criminal background screening reveals that the individual has been convicted, plead guilty, no contest, or is currently under investigation for an Offense Against the Person (Wyoming Statute Title 6, Chapter 2), or an Offense Against Morals, Decency and Family (Wyoming Statute Title 6, Chapter 4), or any similar law of any other state. This includes but is not limited to:

- Sexual assault (W.S. 6-2-301);
- Robbery and Blackmail (W.S. 6-2-401);
- Assault and Battery (W.S. 6-2-501);

- Bigamy (W.S. 6-4-401);
- Incest (W.S. 6-4-402);
- Abandoning or endangering children (W.S. 6-4-403);
- Violation of an order of protection (W.S. 6-4-404);
Because criminal offense definitions vary by state and participant safety is paramount, providers should seek legal advice when interpreting background screening results.

This portal will facilitate the submission of both initial and renewal applications, critical incidents, as well as complaints.
